1. Acceptance of Terms
By accessing and using Simchadig ("the Service"), you accept and agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Service. These terms apply to all visitors, users, and others who access or use the Service.
2. Description of Service
Simchadig is a digital invitation platform that allows users to create, customize, purchase, and share digital invitations for Jewish lifecycle events. The Service includes template browsing, invitation customization, online payment processing, shareable invitation links, and RSVP collection.
3. Accounts
You may create an account using email/password or Google OAuth. You may also use the Service as a guest by providing an email address. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
4. Purchases and Payments
- All prices are displayed in US dollars and are inclusive of applicable fees.
- Payments are processed securely through Stripe. By making a purchase, you agree to Stripe's terms of service.
- Upon successful payment, your invitation becomes active and shareable via a unique link.
- All sales are final. Due to the digital nature of the product, we generally do not offer refunds. However, if there is a technical issue that prevents your invitation from functioning, please contact us and we will work to resolve the issue or provide a refund at our discretion.
5. Editing After Purchase
After purchasing an invitation, you have a 24-hour window to edit the text content of your invitation at no additional cost. After the 24-hour window expires, any changes must be requested through our contact form and may be subject to a fee at our discretion.
6. User Content
You are solely responsible for the content you create and share through the Service. By using the Service, you agree not to:
- Upload or share content that is unlawful, harmful, threatening, abusive, or objectionable
- Use the Service for any illegal purpose
- Impersonate any person or entity
- Interfere with or disrupt the Service or its infrastructure
- Attempt to gain unauthorized access to any part of the Service
7. Intellectual Property
The Service, including its design, templates, graphics, and code, is owned by Simchadig and protected by intellectual property laws. Templates purchased through the Service are licensed for personal, non-commercial use in connection with your event. You may not redistribute, resell, or repurpose our templates.
8. RSVP and Guest Data
When guests RSVP to your invitation, their responses (name, attendance status, guest count, and optional message) are stored and made accessible to you. You are responsible for how you use and share this guest data. We do not use guest RSVP data for marketing purposes.
9. Availability and Uptime
We strive to keep the Service available at all times but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss or inconvenience caused by Service downtime.
10. Limitation of Liability
To the fullest extent permitted by law, Simchadig shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability for any claim related to the Service shall not exceed the amount you paid for the specific invitation in question.
11. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
12. Termination
We may terminate or suspend your account at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service ceases immediately.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New Jersey, United States, without regard to its conflict of law provisions.
14. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of significant changes by updating this page and the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the updated Terms.
